In the piece, Reimagining the Music Industry: In Search of a More Perfect Union, Loren – a frequent guest speaker for Vanderbilt – champions a transformation of the music industry’s traditional business model into one that prioritizes more equitable relationships with artists. He outlines challenges inherent to current standard practices, opines that current copyright termination law under the Copyright Act of 1976 is insufficient, and explains why major labels must adapt in an era that increasingly allows artists to succeed without recording company support.
“Twenty-first century changes, including technological advances in distribution and access to information, have created an environment where modern-day artists are far more suspicious of entering into long-term contracts with record labels where the record companies have total control of their careers and 100 percent ownership of their masters,” Loren says. “The best strategy for long-term survival, continued growth, and success is for record labels to proactively create an environment where the artist-label relationship is truly a partnership. This new paradigm would include artists having equity in the ownership of their masters, shorter contract terms for record deals, full statutory rates on all mechanical royalties, recoupment being measured at net receipts instead of the artist’s royalty rate, recoupment triggering artist ownership of masters, and revised copyright termination language that simplifies the process for terminating transfers of copyright.”

Loren was part of the Legal Side of Media, Fashion, Sports, and Technology panel, which highlighted how law intersects with today’s most dynamic industries.
iLead is part of JTB’s various pipeline programs that serve to develop and nurture interest in the law among young persons from socioeconomic, ethnic, and cultural backgrounds underrepresented in the legal profession. Workshops were also held in Texas, Virginia, and Washington earlier this year.

Loren Mulraine spoke at the 2024 American Bar Association Forum on the Entertainment & Sports Industries Spring Meeting on April 12 in Los Angeles. He participated on the panel, Generative A.I. and Music: Synthesizer, Sampler or Rise of the Machines?
During this CLE discussion, Loren and his fellow panelists outlined recent proposed legislation and litigation relevant to the music industry. The CLE focused on the functions of generative artificial intelligence to either “supercharge” or supplant the talents and abilities of recording artists and songwriters. Drawing from his experiences as both a recording artist and attorney, Loren explored topics such as copyright, trademark, and name and likeness laws, such as the United States Copyright Act, and key issues affecting artists’ ability to license their voice rights.

During the session, Sound-a-like Issues: From Midler v. Ford Motor Co. to Astley v. Hauri, Loren moderated a discussion between Suzanne Kessler, Loeb & Loeb’s Tim Warnock, and Mandell Menkes’ Peter Strand about the lawsuit singer Rick Astley recently filed against rapper Yung Gravy. The panelists analyzed the development of the doctrine prohibiting the creation and use of a person’s voice without permission and also discussed the application of those concepts to the use and misuse of AI.
The panel was part of the conference’s three-day programming featuring leading entertainment and sports attorneys discussing a wide spectrum of entertainment and sports topics. Loren Mulraine spoke at the Adventist Risk Management, Inc. 2023 Risk Management Conference on September 13 in Fort Meyers, Florida.
During the session – Copyright, Law and the Modern Church: Understanding the Legal Framework – Loren educated church leadership about copyright, licensing, and media risk. Attendees gained valuable insight on avoiding legal issues in the era of remote services, recorded worship, and content creation and distribution.

Loren Mulraine participated on a panel for the April 28 virtual conference, Culture & IP: Analogs to Intellectual Property in Different Cultures. The event was hosted by the George Mason University Center for Intellectual Property x Innovation Policy (C-IP2).
During the session, Gatekeeping/Gateopening Intellectual Property in Cultural Expression, Loren and his fellow IP thought leaders examined and challenged the traditional boundary drawing of the IP industry. They also contemplated how expanding IP’s reach can better support underrepresented artists and expressive works. Loren highlighted the evolution of the music industry as an example.
“Historically, the balance of power between artists and corporate entities has been anything but balanced,” he said. He also noted that shifts in the industry, such as increased recording avenues and the rise of streaming, have started to change this power dynamic. As a result, “artists of color recognizing their value” have greatly contributed to musicians’ increased control of their creative work.
Loren was joined on the panel by Jordana Goodman of Boston University School of Law, Dr. Eden Sarid of the University of Essex Law School, and Dr. Anjali Vats of the University of Pittsburgh School of Law. Dr. Bhamati Viswanathan of New England Law served as moderator.

Loren Mulraine spoke at the Copyright Society 2023 Midwinter Meeting earlier this year in Mirage, California. His CLE session comprised a friendly debate between teams.
During the presentation, The Great Copyright Debate: North v. South, two teams of copyright lawyers – each with an American and one Canadian – debated the virtues and flaws of the two countries’ different approaches to copyright law. Topics included fair use vs. fair dealing, notice and takedown vs. notice and notice, and work for hire vs. work made in the course of employment.
